BotSendy is a WhatsApp Business communication and automation platform operated by BizKonnect Technologies LLP. In these Terms of Service, “BotSendy”, “we”, “us”, and “our” refer to BizKonnect Technologies LLP. By accessing or using the Service, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including vendors, administrators, and end-users.
BotSendy is a WhatsApp Business communication and automation platform operated by BizKonnect Technologies LLP. The Service enables businesses to connect their WhatsApp Business accounts and use features such as messaging, approved message templates, customer communication, chatbots, automation, CRM, analytics, notifications, and related business communication services. BotSendy integrates with the WhatsApp Business Platform provided by Meta to enable these services. BotSendy provides technology and software services to businesses and does not claim ownership of WhatsApp or Meta's services.
You must provide accurate and complete information during registration. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old and have the legal authority to bind your organization to these terms.
You agree to comply with all applicable Meta and WhatsApp policies and requirements, including the WhatsApp Business Messaging Policy, Business Policy, and Commerce Policy, as applicable. You are responsible for obtaining appropriate consent or opt-in from your customers before sending messages where required, using approved message templates where applicable, honoring customer opt-outs, and ensuring that your communications comply with applicable laws and regulations. We may restrict, suspend, or terminate access to the Service where we reasonably believe that an account is violating Meta or WhatsApp policies, applicable law, or these Terms.
You agree not to: send unsolicited messages (spam), harass or abuse contacts, send illegal or harmful content, violate intellectual property rights, attempt to reverse engineer the platform, use the service for fraudulent activities, or exceed your plan's messaging limits without upgrading.
Paid plans are billed monthly or annually as selected. All payments are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice. Failed payments may result in service suspension. WhatsApp conversation charges are separate and billed based on Meta's pricing.
Your use of the Service is also governed by our Privacy Policy. You remain responsible for ensuring that you have the necessary rights, permissions, notices, and consents required to collect and process customer information through the Service. Where BotSendy processes customer information on your behalf to provide the Service, we process such information for the purposes of providing, maintaining, securing, and improving the Service and in accordance with our Privacy Policy and applicable law. You are responsible for ensuring that your use of customer data through BotSendy complies with applicable privacy and data protection laws and the applicable Meta and WhatsApp policies. WhatsApp Business Platform Data: BotSendy may process information received through the WhatsApp Business Platform, including WhatsApp Business account information, phone numbers, message and conversation information, message templates, and related account information, to provide messaging, customer communication, automation, customer support, notification, and related services on behalf of our clients. We use such information only as necessary to provide and operate the Service and for legitimate operational, security, and support purposes. We do not sell WhatsApp Platform Data or use it for unrelated advertising purposes.
We aim to maintain reliable and continuous access to the Service but do not guarantee uninterrupted or error-free availability. Service availability may be affected by scheduled maintenance, infrastructure providers, Meta/WhatsApp services, telecommunications networks, internet connectivity, or events beyond our reasonable control.
The Service, including its software, code, design, documentation, features, and BotSendy branding, is owned by or licensed to BizKonnect Technologies LLP and is protected by applicable intellectual property laws. You retain ownership of your data and content that you submit to the Service, subject to the rights necessary for us to provide the Service.
Following termination, we may retain certain information for a limited period where necessary for legitimate business purposes, security, fraud prevention, dispute resolution, legal obligations, or compliance requirements. Subject to applicable law and our Privacy Policy, customer data will be deleted or anonymized when it is no longer required.
The existing limitation is reasonable as a starting point, but because you are an Indian LLP, I recommend having an Indian technology lawyer review the final liability, indemnity, refund, and dispute provisions. In particular, consider adding an Indemnification section covering misuse of WhatsApp, unlawful messaging, lack of customer consent, and violations caused by the customer's content.
These terms are governed by the laws of India. Any disputes shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration in India.
We may update these terms from time to time. Material changes will be notified via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
